The NAACP [advocacy website] filed a lawsuit [complaint, PDF; press release] Wednesday against the Department of Homeland Security (DHS), former acting secretary Elaine Costanzo Duke and current secretary Kirstjen Nielsen after the Trump administration revoked the Temporary Protected Status (TPS) for Haitian citizens in November 2017.

TPS was created to allow Haitians work authorization and temporary residency in the US after the county suffered a devastating earthquake, hurricane and cholera outbreak in a matter of six years.

The complaint alleges that the decision to rescind TPS is racially motivated and violates the Fifth Amendment. The NAACP also asserts that both the former and current secretaries failed to take “genuine, good faith efforts” when reviewing Haiti’s conditions and how revocation of TPS would effect those involved with the legislation.
