FedEx sues Trump for tariff refund

FedEx filed a lawsuit against the Trump administration on Monday to recover a full refund of tariffs FedEx payed to comply with the president’s several executive orders imposing high tariffs on imports in 2025.

FedEx filed their suit in the US Court for International Trade. The company seeks “a full refund from Defendants of all IEEPA duties Plaintiffs have paid to the United States.” FedEx specifically seeks reimbursement for costs incurred when it complied with President Trump’s 2025 executive orders imposing tariffs on almost all imported goods.

The Trump administration justified its authority to impose tariffs under the International Emergency Economic Powers Act (IEEPA). IEEPA “provides the President broad authority to regulate a variety of economic transactions following a declaration of national emergency.” Trump’s tariffs came as a purported means to protect the US economy, as the White House explained:

Large and persistent annual U.S. goods trade deficits have led to the hollowing out of our manufacturing base; resulted in a lack of incentive to increase advanced domestic manufacturing capacity; undermined critical supply chains; and rendered our defense-industrial base dependent on foreign adversaries.

These foreign import tariffs have recently been halted, as the Supreme Court on Friday ruled, in Learning Resources, Inc. v. Trump, that the IEEPA does not authorize the president to impose tariffs. The ruling led President Trump to release Executive Order 14389, titled “Ending Certain Tariffs” on February 20, which directed federal agencies to stop collecting tariffs from earlier 2025 executive orders. 

FedEx is the first major corporation to bring a lawsuit against the Trump administration to recover from their payment of these tariffs since the Supreme Court ruled their imposition was illegal. Costco brought a similar suit against the administration in December 2025.
