US states sue Trump administration over conditional federal funding

A coalition of 20 Democratic state attorneys general filed two federal lawsuits on Tuesday, claiming that US President Donald Trump’s administration is threatening to withhold billions of dollars in transportation and disaster-relief funds unless states agree to certain immigration enforcement actions.

In the transportation funding complaint, the United States Department of Transportation (DOT) and DOT Secretary Sean Duffy are both being sued in their official capacities. States have received essential federal funding for the development and maintenance of transportation infrastructure across the United States for years. The complaint alleges that the federal government has attempted to impose immigration enforcement conditions on federal funding, threatening to defund states that are noncompliant. The complaint further alleges that the Trump administration’s efforts began in Trump’s first term, with Executive Order 13.768. That same effort has been carried into this term, with the “Duffy Directive” imposing immigration enforcement conditions on DOT funding. As it stands, states face the risk of losing billions in federal funding for transportation infrastructure if they are noncompliant.

The disaster-relief funding complaint alleges that the Department of Homeland Security (DHS) has introduced new conditions for federal grants, requiring states to allocate resources for federal immigration enforcement. States and local governments have depended on federal funding to enhance their disaster preparedness and response capabilities. According to the complaint, the new conditions being imposed by DHS jeopardize over $3 billion in annual Federal Emergency Management Agency funding.

Attorney General of New York Letitia James released two official statements announcing the lawsuits. In her statements, James emphasizes the potential dangers that the lack of federal funding could cause while maintaining the illegality of the Trump administration’s latest immigration enforcement efforts.
