Donald Trump asks for ‘executive privilege’ to stop Mike Pence from testifying on January 6 insurrection

Former US President Donald Trump Friday asked a federal court to block former Vice President Mike Pence from speaking to a grand jury about certain matters covered by executive privilege as part of the criminal investigation into efforts to overturn Trump’s 2020 election loss.

The Department of Justice (DOJ) had previously asked a judge to compel Pence to give evidence in front of the grand jury. Trump’s legal representatives had made clear that they intended to assert executive privilege over Pence’s testimony. The jury had issued a subpoena for documents and testimony from Pence in relation to the January 6, 2021, riots.

An unnamed CNN source has informed the platform that the request came in a new secretly submitted filing in a sealed proceeding on Friday. The nature of the sealed hearing is still unclear, and there is no timeline provided as to whether this could be resolved in a district court, or potentially progress to the Supreme Court.

There are multiple allegations against Trump and supporters, including that he pressured Pence and other government officials to “find” enough votes to overturn Biden’s election. Donald Trump later tweeted about the leaked phone call.

There were also multiple leaks by White House officials that Trump had agreed with the “hang Mike Pence” chants from rioters, and ordered for no action to be taken to quell the insurrection.

The DOJ has also served subpoenas to Trump’s daughter and son-in-law Ivanka Trump and Jared Kushner, as well as former White House Chief of Staff Mark Meadows.

In a 32-page submission, the DOJ submitted that Trump’s use of executive privilege does not extend to this matter, and that the court should “reject that categorical argument.”
