Arizona judge awards governor-elect court fees over former opponent’s failed election lawsuit

An Arizona district court Tuesday ordered former gubernatorial candidate Kari Lake to pay Arizona’s governor-elect Katie Hobbs court fees relating to a lawsuit that challenged the outcome of the November election. The court confirmed Hobbs’s election is official and ordered Lake to pay $33,040.50 in expert witness fees.

The case arose on December 9 when Lake challenged her loss in the race for Arizona governor. Lake claimed that technical issues at polling places on election day drove enough voters away that would have changed the election in her favor. The final election results were 1,287,890 votes for Hobbs and 1,270,744 votes for Lake. Lake also claimed that illegal ballots were counted when they should not have been. As a result, the district judge allowed Lake to inspect ballots from the election. Regardless of her efforts, the court dismissed Lake’s claims of election misconduct. Afterwards, Hobbs filed a motion requesting witness and attorney fees as well as the court to sanction Lake’s legal team.

In response to Hobbs’s motion, the court stated that Lake’s claims were not groundless or brought in bad faith, so it declined to award Hobbs attorneys fees or impose sanctions on Lake’s legal team.

Lake immediately Tuesday filed a notice of appeal with the Arizona Court of Appeals. She challenged the validity of the fees and claimed she would file with the Arizona Supreme Court for consideration as well.
