US federal judge rules against Biden administration policy narrowing detention and deportation of immigrants

A US federal judge Friday granted a request to dismiss a policy by President Joe Biden’s administration that narrows the detaining and deportation of immigrants.

In a memo released in September last year, the Department of Homeland Security (DHS) called for a refocusing. DHS said that it would “prioritize for apprehension and removal noncitizens who are a threat to our national security, public safety, and border security.”

US District Court for the Southern District of Texas Judge Drew Tipton said in his opinion that enforcing the memo is “arbitrary and capricious.” The opinion continues to state that the memo violates “a foundational principle of administrative law.”

Tae Johnson, director of US Immigration and Customs Enforcement, defended the policy stating that it focused on the limited resources they have to work with “to achieve the greatest security and safety impact.”

Friday’s order is the latest outcome in more than a dozen lawsuits by Texas and other states that oppose Biden’s new immigration policy.
