US Federal Trade Commission investigates baby formula shortage

The US Federal Trade Commission (FTC) launched an investigation Tuesday into the US’s ongoing infant formula shortage.

The FTC’s inquiry includes soliciting public comments regarding “factors that may have contributed to the infant formula shortage during the recall of certain Abbott formula products beginning in February 2022 as well as its impact on families and retailers.” The FTC would like the public’s information regarding infant formula scams, infant formula priced exorbitantly by resellers, and a list of various other scenarios.

Additionally FTC Chair Lina M. Khan’s issued a statement which outlined four actions the FTC will pursue regarding the infant formula shortage: 1) investigate and seek to fully enforce the law against individuals who deceive, exploit, or scam people attempting to purchase infant formula, 2) examine unlawful economic discrimination which may limit formula availability examine, 3) launch a public inquiry to identify factors that contributed to the infant formula shortage, and 4) use lessons it learns from this incident to inform policy and enforcement in other industries.
