Four states urge Supreme Court to reject Texas efforts to overturn 2020 election

The states of Georgia, Michigan, Pennsylvania and Wisconsin filed separate briefs on Thursday urging the US Supreme Court to reject Texas’s efforts to overturn the 2020 election results.

Texas Attorney General Ken Paxton filed a complaint with the Supreme Court Tuesday against Georgia, Michigan, Pennsylvania and Wisconsin, seeking to overturn their 2020 presidential election results. On Wednesday 17 other states filed amicus briefs in support of Texas, and President Donald Trump also joined the lawsuit.

On Thursday, the four states separately filed briefs urging the Supreme Court to reject Texas’ efforts. The four states offered similar arguments in their briefs. All four argued that Texas lacked standing to pursue the claim, and that its assertions of violations of law were meritless on their face. According to all four briefs, Texas failed to state a claim under the Electors Clause, Due Process Clause, or Equal Protection Clause.

Wisconsin, Michigan and Pennsylvania argued that Texas’s suit is barred by principles of laches, as Texas allegedly waited too long to bring the suit. Georgia, Michigan, and Pennsylvania argued that Texas is pursuing nonjusticiable political questions and that the Supreme Court should decline to exercise original jurisdiction because there is no case or controversy.

All four briefs urged that Texas was not entitled to injunctive relief and that granting the injunctive relief to Texas would greatly harm the public interest.

Texas is expected to file a brief in response to the filings.
