EPA reaches settlement with Antero fracking company over Clean Water Act violations

The US Department of Justice announced Monday that it had reached a settlement agreement with Antero Corporation for their improper disposal into waterways violating Section 404 of the Clean Water Act.

The Environmental Protection Agency (EPA) and West Virginia Department of Environmental Protection filed a complaint against the company for their hydraulic fracking projects that impacted over 32 sites in West Virginia. The Clean Water Act requires companies to obtain a permit for the discharge of of dredged or fill materials into navigable waters. The dredge and fill materials are a result of Marcellus shale natural gas fracking and the drill pads creates by Antero.

Cosmo Servidio, an EPA administrator said that, “This settlement seeks to rectify harm done to U.S. waters from unauthorized activities undertaken by Antero, and demonstrates that federal and state regulators are committed to pursuing violations that threaten human health and the environment.”

Antero will pay $3.15 million from the settlement and “conduct restoration, stabilization, and mitigation work at impacted sites.”
