Virginia late-term abortion ban ruling [4th Circuit]

Richmond Medical Center for Women, et al. v. Hicks, et al., United States Court of Appeals for the Fourth Circuit, June 3, 2005 [finding unconstitutional a Virginia law prohibiting a controversial late-term partial-birth abortion procedure because it lacks an exception to protect a woman's health]. Excerpt:

Because the Virginia Act does not contain an exception for circumstances when the banned abortion procedures are necessary to preserve a woman's health, we affirm the summary judgment order declaring the Act unconstitutional on its face. We likewise affirm the permanent injunction against enforcement of the Act.
