EPA farm pollution rule illegal, 2nd Circuit rules

[JURIST] The US 2nd Circuit Court of Appeals [official website] has overturned EPA [official website] regulations designed to deal with water pollution from manure pollution on major farms. The court ruled Monday that the regulations [text, PDF], which took effect in February 2003 were not adequate to ensure that large farms would comply with requirements under the Clean Water Act [text, PDF] to control pollution. Major farms produce millions of tons of manure annually, with the waste carrying harmful bacteria and chemicals. Although the majority of states manage the Clean Water Act programs themselves, five state programs are managed by EPA.
