Trial begins in suit over force used in Elian Gonzalez raid

[JURIST] US District Judge K. Michael Moore began hearing a case [Judicial Watch (plaintiff's counsel) press release] Monday against the US government brought by supporters of Cuban refugee Elian Gonzalez [Wikipedia article]. The plaintiffs in the case, who were protesting outside the Miami home of Gonzalez's relatives when FBI agents seized the boy in 2000, say the agents used excessive force and are suing for negligence, assault and battery and infliction of emotional distress. During the first day of trial, Judge Moore heard testimony that residents of the Miami neighborhood were tear-gassed for no reason. AFP has more. The Miami Herald has local coverage. Read the original complaint in the case; Judge Moore has since reduced the number of plaintiffs to those who were not on the Gonzalez property or inside the house but were behind police barricades or on their own property.
