Defense of Marriage Act challenge dropped

[JURIST] Lawsuits brought by three same-sex couples married in Massachusetts and Canada seeking to have their marriages recognized in Florida have been dropped because the plaintiffs do not want to risk having the US Supreme Court set precedent by rejecting their case. Two of the three suits, which challenge the federal Defense of Marriage Act [text], were dismissed by a federal judge [opinion; JURIST report] last week. The plaintiffs based their decision not to appeal the dismissal in part because the Supreme Court last week refused to hear a challenge [JURIST report] to a Florida law that prevents homosexuals from adopting children.
